Who we are
We are Kommissary, a New York-born, MWBE-certified food and essentials company. We support DOE Students in Temporary Housing and Medicaid-enrolled clients with reliable, on-time delivery of food boxes and meals. Kommissary ("we," "our," or "us") is committed to protecting the privacy and security of everyone who interacts with us, whether you are an institutional partner submitting a request or an individual client receiving deliveries. This Privacy Statement explains how we collect, use, and safeguard information provided to us.
Information We Collect
- From institutional partners (e.g., DOE sites, schools, and care-program partners): organization name, contact person name, email, phone number, delivery address, and order details (items, quantities, timing).
- From individual clients receiving deliveries: name, delivery address, mobile phone number (when you opt in to SMS notifications), and delivery scheduling information provided to us by you or by a care-program partner on your behalf.
We do not collect or store student, staff, or sensitive personal data beyond what is necessary to fulfill a delivery.
SMS / Text Messaging Program
Kommissary operates an SMS delivery-reminder program for clients enrolled in partner care programs, including the SCN SOMOS Care Network. If you opt in, you will receive recurring text messages from Kommissary notifying you of scheduled deliveries (for example, "Hi Jane, this is Kommissary. Your food packages are scheduled for delivery tomorrow between 9AM-5PM").
- How you opt in. During enrollment in a Kommissary-supported care program, a care-program representative will verbally ask whether you would like to receive SMS delivery reminders at the phone number you provide. Consent is captured verbally over the phone and recorded in our enrollment system, along with the date and time of consent.
- Program details. Message frequency varies based on your delivery schedule (typically one to two messages per scheduled delivery). Message and data rates may apply. Reply STOP to unsubscribe at any time. Reply HELP for help, or contact us at host@kommissary.com.
- No third-party sharing of SMS data. Mobile phone numbers and SMS opt-in consent are never sold, shared, rented, or transferred to any third party, affiliate, or partner for marketing or promotional purposes. This includes our care-program partners such as SCN SOMOS Care Network. We share only the minimum operational delivery information (such as delivery address and scheduled delivery window) with fulfillment partners strictly to complete scheduled deliveries; mobile numbers and SMS opt-in consent are not included in that sharing and are used solely by Kommissary to send the delivery reminders described above.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
How we use your information
We use the information we collect to fulfill deliveries, schedule and confirm delivery windows, communicate with institutional partners about orders, send SMS delivery reminders to clients who have opted in, respond to inquiries and support requests, and comply with applicable legal obligations.
Who we share your data with
We do not sell or rent personal information. We share operational delivery information with fulfillment and care-program partners (such as SCN SOMOS Care Network) only as necessary to schedule and complete deliveries. As stated above, mobile phone numbers and SMS opt-in consent are never shared with these partners or any third party for marketing or promotional purposes. We may disclose information where required by law, legal process, or to protect the rights, property, or safety of Kommissary, our clients, or others.
How long we retain your data
We retain personal information for as long as necessary to provide our services, comply with our legal obligations, resolve disputes, and enforce our agreements. SMS opt-in records (phone number, consent timestamp, and source of consent) are retained for as long as you are an active subscriber and for a reasonable period afterward to demonstrate compliance, then deleted.
What rights you have over your data
You may request an exported copy of the personal data we hold about you and request erasure of that data, except where we are obligated to retain it for administrative, legal, or security purposes. To opt out of SMS at any time, reply STOP to any Kommissary message or contact host@kommissary.com.
Children's privacy
Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we may have collected information from a child under 13, please contact us at host@kommissary.com and we will delete it.
Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of the policy. Material changes will be communicated to subscribers where appropriate.
